Launch of the regulatory procedure to amend the Regulation defining the rules and establishing the procedures applicable to the regime for access to and exercise of space activities


Notice is hereby given that, in accordance with and for the purposes of paragraph 1 of article 98 of the Administrative Procedure Code, within the scope of the assignments provided for in paragraph 1 u) of article 8, and in the exercise of the regulatory power provided for in paragraph 2 e) of article 9, both of ANACOM’s Statuteshttps://www.anacom.pt/render.jsp?contentId=1351851, approved by Decree-Law No 39/2015, of 16 March, as well as within the framework of the assignments provided for in paragraph 1 e) of article 22 and article 30 of Decree-Law No 16/2019https://www.anacom.pt/render.jsp?contentId=1475024, of 22 January, as amended by Decree-Law No 20/2024https://www.anacom.pt/render.jsp?contentId=1773528, of 2 February, the Board of Directors of Autoridade Nacional de Comunicações (ANACOM) decided, on 20 May 2024, to launch the regulatory procedure to amend Regulation No 697/2019https://www.anacom.pt/render.jsp?contentId=1496233, of 5 September, with regard to articles 5, 7, 8, 9-B, 9-C, 16 and 17 of Decree-Law No 16/2019, of 22 January, as it stands, as well as paragraph 5 of article 2 of Administrative Rule No 279/2023https://www.anacom.pt/render.jsp?contentId=1751544, of 11 September, on the establishment of standards for calculating the maximum probable damage for the purposes of minimum limits of insured capital.

The purpose of this regulatory procedure is to bring the aforementioned Regulation into line with the amendments introduced by Decree-Law No 20/2024 of 2 February, in particular with regard to:

a) The procedure for issuing prequalification certificates for space activities;

b) The procedure for granting licences for space activities, including launch centre operations, and criteria for assessing the conditions for granting such licenses;

c) The elements subject to registration with the Space Authority;

d) The transfer of ownership of space objects;

e) The establishment of rules for calculating the maximum probable damage, for the purposes of the minimum limits of the insured capital.

To this end, interested parties may, within 10 working days of the date of this notice, send ANACOM, in writing, the contributions and suggestions that they consider should be taken into account in the preparation of the draft amendment to the Regulation, to the following address: reg.espaco@anacom.pt, indicating which elements are considered confidential, in which case a redacted version should also be sent. The deadline for submitting contributions is 6 June 2024.

ANACOM will analyse the comments and suggestions made by interested parties and take them into account when drawing up the draft regulation, on which the interested parties will be able to comment when it is submitted to the public consultation procedure, in accordance with article 10 of the Statutes of this Authority, through publication on ANACOM’s institutional website (www.anacom.pt) and in Series II of the Official Gazette.
