ANACOM launches public consultation on the renewal of the right of use for the radio spectrum assigned to MEO for DTT services


On 14 February 2023, ANACOM approved the draft decision on the renewal of the right of use for frequencies - which, in line with the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=1727429 (ECL) now in force, will be known as the Right of Use for the Radio Spectrum (RURS) - granted to MEO - Serviços de Comunicações e Multimédia (MEO) for the digital terrestrial television broadcasting service (DTT) - Multiplexer A (MUX A).

ANACOM takes the view that there is nothing to prevent the renewal of the RURS for a 7-year period (until 10 December 2030), which will have an impact on significant sections of the population, as well as on the free-to-air television retail market and the free-to-air digital terrestrial broadcasting wholesale market for end-users. The Authority further considers that no conditions other than those set out above should be imposed and that such conditions should remain applicable.

Moreover, ANACOM deems it appropriate to update the wording of the RURS, in order to include the amendments resulting from the entry into force of the new ECL, also integrating the updated information on the terrestrial coverage obligations.

This draft decision was submitted to a prior hearing of stakeholders  (MEO, RTP, SIC, TVI and ARTV - Parliament Channel), under the Administrative Procedure Code, as well as to the general consultation procedure set out in article 10 of the ECL.

In both cases, a period of 30 working days has been set for stakeholders to comment - in writing and in Portuguese - whereby the deadline for comments ends on 29 March 2023. Comments should preferably be sent by email to renovacao.duer.tdt@anacom.pt1.

Once the consultation procedure is completed, contributions received will be made public, whereby interested parties are also requested to send a version with all confidential information removed for publication on this website.
