Public consultation on CTT's request to change the date of the entry into force of ANACOM's decision on the distribution of postal items in premises other than the home


On 19 April 2022, ANACOM approved a draft decision on the request from CTT – Correios de Portugal (CTT) to change the date of the entry into force of ANACOM's decision of 29 April 2021https://www.anacom.pt/render.jsp?contentId=1624201 on the distribution of postal items to premises other than the home. On this date, approval was also given to suspension of the decision's effectiveness until a final decision is issued on the request submitted by CTT.

In view of CTT's request, ANACOM, taking into account:

  • the complexity of the procedures that will have to be adopted within the scope of the implementation of the decision of 29 April 2021 and the time required to carry them out;
  • that the decision in question began to take effect with the entry into force of the new concession contract, on 8 February 2022;
  • that adequate implementation of the provisions of the decision justifies granting the (new) concessionaire a longer period for the execution of all actions and measures requiring compliance; and
  • the impossibility of concluding analysis of and issuing a decision on CTT's request prior to the entry into force of ANACOM's decision of 29 April 2021 on the distribution of postal items to premises other than the addressee's home, decided to grant the request submitted by CTT, amending point 3 of the Decision of 29 April 2021https://www.anacom.pt/render.jsp?contentId=1624201 on the distribution of postal items to premises other than the home, as follows:

"To determine that the conditions and obligations set out in this decision shall be in force from 01 January 2023 until expiry of the contract concluded by the Portuguese State for the provision of services that are part of the universal service following expiration of the current concession".

It was decided to submit this draft decision to the hearing of interested parties and to the public consultation procedure provided for in article 9 of Lei Postal (Postal Law)https://www.anacom.pt/render.jsp?contentId=1366366 for a period of 20 working days. Contributions should therefore be sent no later than 24 May, in writing and in Portuguese, by email to distrib.domiciliaria@anacom.ptmailto:distrib.domiciliaria@anacom.pt.

Once the consultation process has been concluded, the contributions received will be made public. Therefore, for the purposes of publication on this website, interested parties should also submit a non-confidential version of their responses excluding items considered confidential.
