ANACOM approves allocation of rights of use of frequencies following the 5G auction


ANACOM's Board of Directors today (23 November 2021) approved the final report on the auction, containing the decision to allocate rights of use of frequencies to the following companies:

  • DENSE AIR Portugal, Unipessoal (DENSE AIR);
  • DIXAROBIL TELECOM, Sociedade Unipessoal (DIXAROBIL);
  • MEO – Serviços de Comunicações e Multimédia (MEO);
  • NOS Comunicações (NOS);
  • NOWO Communications (NOWO);
  • VODAFONE Portugal – Comunicações Pessoais (VODAFONE).

This decision follows from the decision of 30 October 2020https://www.anacom.pt/render.jsp?contentId=1574202, in which ANACOM's Board of Directors approved the Regulation defining the procedures applicable to the auction and the conditions governing the Rights of Use of Frequencies allocated in the 700 MHz, 900 MHz, 1800 MHz, 2.1 GHz, 2.6 GHz and 3.6 GHz bands (Regulation n.o 987-A/2020 of 05 Novemberhttps://www.anacom.pt/render.jsp?contentId=1573881, or Auction Regulation).

On 30 June 2021, Regulation n.o 596-A/2021https://www.anacom.pt/render.jsp?contentId=1669881 was published, amending paragraphs 1 and 3 of article 27 of the Auction Regulation, while on 20 September 2021, Regulation n.o 867-A/2021https://www.anacom.pt/render.jsp?contentId=1703983 was published, amending paragraph 1 of article 30 of the Auction Regulation.

The main bidding phase concluded on 27 October 2021, with completion of 1,727 rounds, with completion of the auction's bidding phasehttps://www.anacom.pt/render.jsp?contentId=1709636.

The assignment phase was held on 29 October 2021. In this phase, within the criteria defined in the Auction Regulation. the winning bidders were able to choose the exact location of the lots they had won (except for spectrum in the 900 MHz band which, in accordance with the Auction Regulation, will be the subject of a separate process).

Following completion of the assignment phase, on 04 November 2021, ANACOM approved the draft auction report containing the draft decision to grant the Rights of Use of Frequencieshttps://www.anacom.pt/render.jsp?contentId=1709790, in compliance with the provisions of article 36 of the above Regulation, which was submitted to a prior hearing of interested parties for a period of ten working days.

Following the prior hearing period, the respective report was prepared, giving analysis of the responses received and setting out ANACOM's position. This report forms an integral part of the final report and substantiates the decision to award the Rights of Use of Frequencies.

As such, by decision of 23 November 2021, ANACOM's Board of Directors decided to allocate:

1. To DENSE AIR, the Right of Use of Frequencies corresponding to 40 MHz in the 3.6 GHz frequency band, with assignment of the 3440-3480 MHz frequencies for this purpose.

2. To DIXAROBIL, the Rights of Use of Frequencies corresponding to:

a. 2 x 5 MHz in the 900 MHz band within the frequencies to be assigned under the provisions of article 39 of the Auction Regulation;

b. 2 x 5 MHz in the 1800 MHz band, with assignment of the 1780-1785 MHz / 1875-1880 MHz frequencies for this purpose;

c. 2 x 5 MHz in the 2.6 GHz frequency band (FDD), with the 2500-2505 MHz / 2620-2625 MHz frequencies assigned for this purpose;

d. 25 MHz in the 2.6 GHz frequency band (TDD), with the 2595-2620 MHz frequencies assigned for this purpose;

e. 40 MHz in the 3.6 GHz frequency band, with the 3400-3440 MHz frequencies assigned for this purpose.

3. To MEO, the Rights of Use of Frequencies corresponding to:

a. 2 x 5 MHz in the 700 MHz frequency band), with the 703-708 MHz / 758-763 MHz frequencies assigned for this purpose;

b. 2 x 2 MHz in the 900 MHz band within the frequencies to be assigned under the provisions of article 39 of the Auction Regulation;

c. 90 MHz in the 3.6 GHz frequency band, with the 3710-3800 MHz frequencies assigned for this purpose.

4. To NOS, the Rights of Use of Frequencies corresponding to:

a. 2 x 10 MHz in the 700 MHz frequency range, with 723-733 MHz / 778-788 MHz frequencies assigned for this purpose;

b. 2 x 2 MHz in the 900 MHz band within the frequencies to be assigned under the provisions of article 39 of the Auction Regulation;

c. 2 x 5 MHz in the 2.1 GHz frequency band, with 1954.9-1959.9 MHz / 2144.9-2149.9 MHz frequencies assigned for this purpose;

d. 100 MHz in the 3.6 GHz frequency band, with the 3610-3710 MHz frequencies assigned for this purpose.

5. To NOWO, the Rights of Use of Frequencies corresponding to:

a. 2 x 10 MHz in the 1800 MHz frequency band, with the 1770-1780 MHz / 1865-1875 MHz frequencies assigned for this purpose;

b. 2 x 5 MHz in the 2.6 GHz frequency band (FDD), with the 2505-2510 MHz / 2625-2630 MHz frequencies assigned for this purpose;

c. 40 MHz in the 3.6 GHz frequency band, with the 3480-3520 MHz frequencies assigned for this purpose.

6. To VODAFONE, the Rights of Use of Frequencies corresponding to:

a. 2 x 10 MHz in the 700 MHz band (FDD), with the 713-723 MHz / 768-778 MHz frequencies assigned for this purpose;

b. 90 MHz in the 3.6 GHz frequency band, with the 3520-3610 MHz frequencies assigned for this purpose.

The companies now have a period of 10 working days in which to deposit the final sums. Following these deposits, the titles that substantiate the rights of use of frequencies in all bands will be issued (except 900 MHz which, as already mentioned, will be subject to a separate procedure).
