Allocation of rights of use of numbering to Orange Business Portugal
In accordance with the powers and responsibilities assigned to it by point f) of paragraph 1 of article 8 of ANACOM's Statutes (published in annex to Decree-Law no. 39/2015 of 16 March), by decision of 15 April 2021, ANACOM has approved the allocation of rights of use of numbering (28106xxxx and 28906xxxx) to Orange Business Portugal (Orange) under the provisions of its Statuteshttps://www.anacom.pt/render.jsp?contentId=1351851 and of LCE - Lei das Comunicações Eletrónicas (Electronic Communications Law)https://www.anacom.pt/render.jsp?contentId=975162 as currently worded.
This decision was taken in pursuit of the regulatory objectives set out in point a) of paragraph 1 of article 5 of LCE - Lei das Comunicações Eletrónicas (Electronic Communications Law) and under the powers assigned to ANACOM by point d) of paragraph 2 of this same article 5, as well as under the terms of point q) of paragraph 1 of article 26 of ANACOM's Statutes and pursuant to the provisions of articles 17, 19, 36 and 37, all of the LCE.
Under the terms of this allocation, Orange is made subject to the conditions which are associated with the use of this numbering, as set out in article 37 of the LCE, specifically: as regards exclusive use of numbers from the “2” range for provision of the publicly available telephone service at a fixed location in the designated geographical area; to respect the principles and criteria applicable to the management and allocation of numbering resources, as approved by ANACOM on 2 June 1999; and other principles and criteria that ensure fulfilment of the condition of effective and efficient use, as may be determined by ANACOM in application of the LCE.
ANACOM also decided, pursuant to point f) of paragraph 1 of article 124 of Código do Procedimento Administrativo (Administrative Proceeding Code), to waive the requirement for a prior hearing of interested parties.
