Settlement of dispute between MEO and NOS concerning the price of mobile-to-mobile termination services provided in 2001


On 20 February 2020, ANACOM approved the final decision concerning the request of MEO - Serviços de Comunicações e Multimédia (MEO) to intervene in the administrative resolution of the dispute in which it is opposed to NOS Comunicações (NOS), regarding the price of mobile-to-mobile termination services reciprocally provided in 2001, at the date of the facts between TMN - Telecomunicações Móveis Nacionais (TMN) and OPTIMUS Telecomunicações(OPTIMUS), respectively.

Therefore, and following the analysis performed, this Authority decided to:

  • refuse the request for intervention, submitted by MEO, to establish the price to be applied to termination services reciprocally provided by TMN (currently MEO) and OPTIMUS (currently NOS) in the year 2001, because the maximum period established in paragraph 2 of the referred article 10 of the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=975162 (LCE) has already passed;
  • reject an intervention "under its lawful powers as regulatory agency of the sector", invoked subsidiarily by MEO, because the conditions for the applicability of the first part of paragraph 2(b) of Article 63 of the LCE have not been met.

The report regarding the prior hearing of the interested parties following notification of the draft decision of 21 November 2019https://www.anacom.pt/render.jsp?contentId=1519335 was also approved on this date.
