ANACOM Alerts - more protection for binding period contracts and right to compensation by registered mail


Within the scope of the initiative “ANACOM Alerts”, launched with the aim of reinforcing the information which this Authority makes available to consumers regarding specific sectoral topics, which reflect the main issues raised in complaints received, the following article was published on 20 (in Correio da Manhã) and 21 August (in Jornal de Notícias):

Consumers better protected in binding period contracts

  • Since August 16, operators are now required to provide users with contracts with no binding periods or with 6 and 12 month binding periods.
  • Information on the advantages that justify the binding period and the charges to pay for early cancellation must be made available in a clear and durable medium.
  • Operators may only charge fees for breach of a binding period if they have proof that the consumer has accepted this.

Did you know that loss, theft and damage to registered mail entitles you to compensation?

  • It is true. Loss, theft and damage to registered mail (CTT) entitles you to compensation.
  • This right is the sender’s but under certain situations it can pass to the recipient.
  • In registered mail without an insured value, the compensation corresponds to the actual value of the loss, with a maximum of 20 times the registration fee paid.
  • If you cannot reach an agreement with CTT over compensation issues, then use the Consumer Conflict Arbitration Centres.
