European Commission publishes its preliminary conclusions regarding the consultation on the ePrivacy Directive


On 4 August 2016 the European Commission (EC) published the preliminary conclusions of the public consultation on the evaluation and review of the ePrivacy, Directive which lays down the rules for personal data processing and the privacy approach in the electronic communications’ sector.

By way of a public consultation carried out between 12 April and 5 July 2016, the EC sought out opinions about the effectiveness, efficiency and consistency of the current European Union rules and the possible approaches to a review of the Directive.

The information disclosed reveals that 83% of the replies recognise the importance of rules devoted to privacy and that 76% believe that the ePrivacy Directive has yet to achieve the objective of ensuring total protection of the privacy and confidentiality of electronic communications.

The report containing a detailed analysis of the replies to this public consultation shall be disclosed by the EC in Autumn 2016.
