By decision of 25 May 2016, ANACOM has approved a draft decision on the "wholesale market for call termination on the public telephone network at a fixed location - defining the relevant market, on assessment of significant market power (SMP), and on the imposition, amendment or withdrawal of regulatory obligations".
It was decided to submit the draft decision to the prior hearing of interested parties, in accordance with articles 121 and 122 of the Código de Procedimento Administrativo (Administrative Proceeding Code) and the general consultation procedure provided for in article 8 of LCE - Lei das Comunicações Eletrónicas (Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=975162); under both procedures, interested parties are granted a period of 30 working days in which to respond. Comments should be submitted in writing and in Portuguese.
On the same date, ANACOM approved the report on the prior hearing and public consultation on the draft decision approved by ANACOM decisionhttps://www.anacom.pt/render.jsp?contentId=1289852 of 10 July 2014 on the same subject.
Approval was also given to the report on the prior hearing and public consultation on the fixed termination costing model. The respective draft final decision will only be approved for notification to the European Commission after completion of the public consultation and prior hearing procedures on the market analysis, simultaneously with the approval of the respective draft final decision on this analysis.
