By determination of 23 July 2015, ANACOM approved, pursuant to article 9 of the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?categoryId=333114 (ECL), with immediate effect, provisional and urgent measures relating to the wholesale high-quality access market provided at a fixed location (wholesale leased lines). An amendment is introduced in the methodology implementing the price control obligation, imposed within the scope of the analysis of the wholesale leased line market, approved on 28 September 2010, in the context of MAM and inter-island Ethernet lines, including any terminating segments, trunk segments and/or internal extensions specifically associated to this type of lines, the principle of cost-orientation of prices now being applied.
ANACOM has also determined that these provisional and urgent measures remain in force until the new procedure for market definition and analysis and for imposition of regulatory obligations relating to the wholesale high-quality access market provided at a fixed location is completed, including the respective notification to the European Commission (EC), in line with article 57 of ECL, and ANACOM’s final decision.
Approval was given also to the report of the prior hearing and consultation to which the draft decision approved on 19 December 2014https://www.anacom.pt/render.jsp?contentId=1343361 was submitted, procedures in the scope of which contributions were received from BICS Portugal, MEO - Serviços de Comunicações e Multimédia, NOS - Comunicações and Vodafone Portugal - Comunicações Pessoais, as well as from Autoridade da Concorrência (the Competition Authority - AdC).
Adopted measures and the respective reasoning were also communicated to EC, other national regulatory authorities (NRA) and the Body of European Regulators for Electronic Communications (BEREC), the present decision having also been notified to stakeholders.
