On 11 February 2016, ANACOM approved a draft decision reviewing the analysis of the markets of wholesale local access at a fixed location (market 3a) and of wholesale central access at a fixed location for mass-market products (market 3b), which includes definition of product and geographic markets, assessment of SMP and the imposition, maintenance, amendment or withdrawal of regulatory obligations.
In the present market analysis, ANACOM identified the following markets as relevant for the purposes of ex-ante regulation: wholesale local access market at a fixed location and wholesale central access market at a fixed location (for mass-market products) in non-competitive areas (NC). ANACOM concluded that MEO has SMP in both markets, and thereby imposed obligations as regards access to the network and use of specific network resources, non-discrimination, transparency, accounting separation and price control and cost accounting and financial reporting.
It was decided to submit this draft decision to a prior hearing of interested parties and to the general consultation procedure, with interested parties given a period of 30 working days, under both procedures to respond, in writing and in Portuguese. Comments should therefore be sent, no later than 30 March 2016, by email to mercados3ae3b@anacom.ptmailto:mercados3ae3b@anacom.pt1. Once the consultation process has been concluded, the contributions received will be made public. Therefore, for the purposes of publication on this website, interested parties should also submit a non-confidential version of their responses excluding any items considered confidential.
The draft decision was additionally referred to Autoridade da Concorrência (Portuguese Competition Authority) for an opinion.
Approval was also given to the report on the prior hearing and public consultation conducted with regard to the draft decision reviewing the analysis of the market of wholesale access to network infrastructure at a fixed location (market 4) and wholesale broadband access (Market 5) following determination of 6 February 2012.
