Expiry of obligations imposed on MEO regarding the wholesale market of television broadcasting services over terrestrial analogue networks


On 28 January 2016, ANACOM approved a draft final decision for notification to the European Commission (EC), the Body of European Regulators for Electronic Communications (BEREC) and the national regulatory authorities (NRA) of the remaining Member States of the European Union (EU), by which it declared the expiry, as from 2 April 2012, of the regulatory obligations imposed on MEO - Serviços de Comunicações e Multimédia (MEO) in the context of the wholesale market of television broadcasting services over terrestrial analogue networks.

Following the switch off of terrestrial analogue television and the transition to terrestrial digital television (DTT), which took place on 20 April 2012, the wholesale market for television broadcasting through terrestrial analogue networks ceased to exist once terrestrial analogue broadcasting was discontinued.

Consequently, the obligations imposed on MEO (company declared as having significant market power) have expired due to lack of application. ANACOM therefore considers that the expiry of the obligations imposed on MEO by decision of 2 August 2007 on the definition of product and geographic markets, assessment of SMP and the imposition, maintenance, amendment or withdrawal of regulatory obligations on the wholesale market of broadcasting services for the delivery of content transmitted to final users, should have effect as on 26 April 2012.
