Compensation fund and net costs of the universal service for electronic communications - final decision


On 28 January 2016, ANACOM approved a decision identifying the undertakings required to contribute to the electronic communications universal service compensation fund and determining the amount of the contributions due in respect of the CLSU - Custos Líquidos do Serviço Universal (Net Costs of Universal Service) to be compensated in respect of the 2010-2011 period (CLSU approved in 2014) and for 2014 (the period subsequent to the designation of universal service providers by tender).

As such, ANACOM determined:

  • Revision of the eligible turnover values reported by certain companies for the purposes of calculating the sector's overall eligible turnover for 2014, partially as a result of auditing and analysis performed by ANACOM.
  • The value of overall sector eligible turnover with respect to 2014 at 4,490,912,078.06 euros.
  • The identification of undertakings and the value of each undertaking's contribution for the following purposes:
    - compensation of the CLSU in respect of 2014, as regards the universal service component provided by NOS Comunicações under the contracts concluded with the Portuguese State for the universal service provision of connection to a public communications network at a fixed location and publicly available telephone services;
    - compensation of the CLSU in respect of 2014, as regards the universal service component provided by MEO - Serviços de Comunicações e Multimédia (MEO) under the contract concluded with the Portuguese State for the universal service provision of public pay-telephones;
    - compensation of the CLSU in respect of the 2010-2011 period (CLSU approved in 2014), as regards the universal service provided by MEO as universal service provider in the period prior to designation by tender.
  • A period of 20 working days, following notification of the final decision, for payment of the contributions identified in the preceding paragraph.
  • That MEO shall not be required to make payment of its contributions, given that the amount due is less than the value of the compensation to which it entitled, whereby the amount of compensation to which the company is entitled shall be reduced by the value of their contributions.

Approval was also given to the report on the prior hearing to which the respective draft decision was submitted following ANACOM decision of 17 December 2015.
