Portugal Telecom, S.A. named by the ICP as a company with Significant Market Power

Every year, after previous approval by the national Directorate General for Commerce and Competition, the Instituto de Comunicações de Portugal (ICP) issues a list of companies with significant market power (SMP). The list aims to ensure correct operation of the market from a perspective of full liberalization.

The Board of Administration of the ICP decided to name Portugal Telecom S.A. as an SMP company in the Portuguese markets for interconnection, leased circuits and fixed telephone networks and services.

As a consequence, Portugal Telecom, S.A. is now subject to the provisions of Decree-Law no. 415/98 of 31 December. This legislation establishes the regulatory framework for the interconnection of public telecommunications networks with a view to open, competitive markets and with the objective of ensuring interoperability among public telecommunications services. The guiding principles behind the legislation are promotion of consumer interests and efficient allocation of resources.

The obligations of SMP companies include:

a) To respect the principle of non-discrimination in interconnect supply;

b) To provide, upon the request of interconnection applicants, all information and specifications necessary for interconnection;

c) To respect the confidentiality of the information given by interconnection applicants, using it only for the purposes for which it is intended.
