Markets 1 and 2 - public consultation

By determination of 19 December 2013, ANACOM has approved the following draft decisions:

• on the retail markets of access to the public telephone network at a fixed location and markets of telephone services provided at a fixed location - definition of relevant market, assessment of  significant market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations (market 1);
   
• on the wholesale market of call origination at a fixed location - definition of product and geographic markets, assessment of SMP and imposition, maintenance, amendment or withdrawal of regulatory obligations (market 2).

It was decided to submit these draft decisions to the prior hearing of interested parties, in accordance with articles 100 and 101 of the Código de Procedimento Administrativo (Administrative Proceeding Code), as well as to the general consultation procedure as laid down in article 8 of the Lei das Comunicações Eletrónicas (Electronic Communications Law - Law no. 5/2004 of 10 February as amended by Law no. 51/2011 of 13 September).  A period of 30 working days is provided under each procedure for interested parties to comment.

An opinion on this draft decision was likewise sought from Autoridade da Concorrência (Portuguese Competition Authority), in accordance with the law.
