Decision on unified titles of rights of use of frequencies for terrestrial electronic communication services

By determination of 3 February of 2012, ANACOM has approved the decision on the unification of titles of rights of use of frequencies for terrestrial electronic communication services.

This decision follows from the multiband auction, whose report was approved by determination of 6 January 2012, pursuant to which the decision was made to allocate rights of use of frequencies to  Optimus – Comunicações, S.A. (Optimus), to TMN – Telecomunicações Móveis Nacionais, S.A (TMN), and to Vodafone Portugal – Comunicações Pessoais, S.A. (Vodafone).

It was decided to submit this decision, in the correspondent part thereof, to the prior hearing of interested parties under the terms of articles 100 et seq. of the Código de Procedimento Administrativo (Administrative Proceeding Code) and also to the general consultation procedure under the terms of article 20, paragraph 3, of Law no. 5/2004 of 10 February, as amended by Law no. 51/2011 of 13 September.  Interested parties are provided a period of 20 working days to comment under both procedures.

The decision which is now approved also determines that the National Table of Frequency Allocations (NTFA) be amended accordingly and grants the request put by Optimus to return the block of 2x5 MHz  UMTS-FDD frequencies by amending the respective right of use of frequencies and corresponding radio license, with effect from10 January 2012.
