Consultation on new National Frequency Allocation Plan (NFAP)


The new National Frequency Allocation Plan (NFAP) is now under consultation. It contains the frequency allocation table, indication of the assigned and reserved frequencies and those to be made available in 2005 for electronic communications networks and services, publicly accessible or not, and specifies the cases where frequency usage rights need to be allocated and the respective allocation process. The NFAP also includes indication of the uses for frequencies exempt from radio licence.

Adoption of this instrument derives from the Electronic Communications Law (Regicom – Law no. 5/2004 of 10 February), under terms of which ANACOM, as part of its spectrum management duties, is responsible for planning frequencies as per the criteria for the availability of radio spectrum, guarantee of effective competition in relevant markets, and effective and efficient use of frequencies; it must also annually make public the NFAP.

Given its significant market impact, this document is subject to the general consultation procedure envisaged in Regicom; for this purpose a period of 20 working days has been established, which will end on 19 January 2005.
