Commission adopts communication on review of relevant markets


The European Commission adopted, on 6th February, a communication on the review of relevant markets in the context of the community regulatory framework for electronic communication - Communication on Market Reviews under the EU Regulatory Framework - Consolidating the internal market for electronic communications. The aim of the review is to evaluate the success of consultation mechanisms established under Article 7 of the Framework Directive, as well as to assess the experience so far.

As part of this review The Commission reported the following on 20 September 2005:  16 member states have identified one or more relevant markets without effective competition and have adopted measures to encourage competition; 5 member states have identified one or more of markets with partial competition and have adopted corrective measures; whereas 9 member states have not yet reported their findings in relation to any of the 18 relevant markets.  Of the 152 markets analyzed, 123 were found to be non-competitive, 19 completely non-competitive and 10 partially competitive.

The Commission considers that the consultation procedure in the community context of the measures adopted by the national regulatory authorities have led to greater consistency in the process of imposing obligations on operators.

The Commission’s goal is to improve the consultation procedure and update the list of markets subject to regulation, so that it can follow the technological progress and development in the market which in turn will be reflected in any future review of the regulatory framework for electronic communications.
