Results of the public consultation on VoIP and opening of the associated numbering range


ANACOM  approved on 23 February 2006 the report on the public consultation that was launched following the determination of 4 November 2005 on the regulatory approach to voice services using IP technology (ANACOM). The report contains this authority’s understanding of the issue and the analysis of the comments received from the following entities: Apritel, Ericsson, G9SA, HCV, Media Capital, Netcall, Neuvex, Nortenet, Onitelecom, Grupo PT, Radiomóvel, SGC (on behalf of AR Telecom, Netvoice and WTS), Sonaecom (on behalf of Novis Telecom and Optimus),Tele2 and Vodafone Portugal.

Among other aspects, this understanding contains a characterization of VoIP services and considers adequate to open a new non-geographical numbering range, range “30”, distinguishing the nomadic VoIP service from the telephone service provided at a fixed location. It also establishes that nomadic VoIP service providers must implement number portability, and that the Regulation on Quality of Service duly approved by ANACOM (Regulation no. 46/2005, published in Diário da República on 14 July) applies to companies providing VoIP at a fixed location. All VoIP service providers with numbers of the National Numbering Plan, including the nomadic services, when on national territory, must also assure the routing of the corresponding VoIP calls to the emergency services, allowing calls to 112. The providers of VoIP services at a fixed location must additionally send quarterly statistical information to the other FTS operators. As for the statistical supervision of nomadic VoIP service providers, ANACOM´s will submit to consultation to the interested parties a form to collect those data.

It was thus decided, under the terms of article 17, no. 2, paragraph b) of the Electronic Communications Law (Law no. 5/2004 of 10 February), to open the numbering range “30” to accommodate the provision of nomadic services, and to allocate 10,000 numbers to the providers that are entitled to provide nomadic VoIP services, under the terms defined by ANACOM. The “30” range was included in the scope of portability, considering the terms of paragraph g) of no. 1 of article 3 of the Portability Regulation.

It was also decided, further to the joint terms of paragraph j) of no. 1 and of no. 2, of article 27 of Law no. 5/2004 of 10 February that the providers of nomadic VoIP services with numbers of the National Numbering Plan, when on national territory, must assure the routing of VoIP calls to 112.
