Determination
With the entrance into force of new ITED/ITUR regime, ANACOM holds jurisdiction to designate and register training providers, under the terms of article 46 of Decree-Law no. 123/2009 of 21 May, as amended by Decree-Law 258/2009 of 25 September. This designation is carried out by verifying the fulfillment of technical materials and of technical qualifications of personnel, whose definitions were achieved by ANACOM, in conjunction with ANQ - Agência Nacional para a Qualificação (National Qualification Agency) and DGERT - Direcção Geral do Emprego e das Relações de Trabalho (Directorate-General of Employment and Labour Relations), under the terms of article 45, no.3, of this Decree-Law, and approved in Deliberation 043109, of 16 December 2009, of the Conselho de Administração (Management Board) of ANACOM.
In these powers, a need has been felt by the training providers, for the existence of a document certifying that designation, which certifies the recognition of all technical and material conditions to administer the courses in these areas, as well as validity of designation.
This document constitutes a certificate of the administrative record, the record of the training providers, to which the interested parties are entitled, under the terms of article 62, no.3, of the Code of Administrative Procedures, which will be issued under the form of a certificate of registration of the training entity ITED / ITUR.
In these terms and in the powers of appointment and registration of the training providers, under the terms of article 46, of Decree-Law no.123/2009, of 21 May, as amended by Decree-Law no. 258/2009, of 25 September, as well as under the terms of article 62, no.3, of the Code of Administrative Procedure, and of article 26, I), of Decree-Law no. 309/2001, of 7 September, the CA of ANACOM decided to approve the issuance of registration certificates to the training providers ITED and ITUR, in accordance with the models attached.
