Minimum set of leased lines and wholesale terminating and wholesale trunk segments of leased lines (markets 7, 13 and 14) - public consultation


ANACOM launches at 18 of March, for a 30-working-day time limit, a public consultation on the minimum set of leased lines and wholesale terminating and wholesale trunk segments of leased lines (markets 7, 13 and 14 of the Commission Recommendation 2003/311/EC, of 11 February 2003), which comprises the definition of product markets and geographic markets, assessments of significant market power (SMP) and imposition, maintenance, alteration or suppression of regulatory obligations.

In the consultation document, which represents ANACOM’s draft decision on the subject, the following have been deemed as relevant markets for the purpose of ex ante regulation:

- the minimum set of analogue and digital leased lines up to and including 2 Mb/sec, comprising the entire national territory;

- the wholesale analogue and digital terminating segments of leased lines, irrespective of capacity, comprising the entire national territory;

- the wholesale analogue and digital trunk segments of leased lines, irrespective of capacity, comprising the entire national territory.

At the same time, the companies of the PT Group that operate in the identified relevant markets were identified as having significant market power (SMP).

The obligations to be imposed upon these companies vary according to the relevant markets under consideration. Thus, as regards market 7 (minimum set of analogue and digital leased lines up to 2 Mb/sec), these include the obligation of non-discrimination in relation to access and interconnection provision and respective information provision, the obligation of transparency in relation to the publication of information and price control and cost accounting obligations. The obligations applicable in the scope of markets 13 and 14 (wholesale terminating and wholesale trunk segments of leased lines) are: access to and use of specific network facilities, non-discrimination in relation to access and interconnection provision and respective information provision, transparency in relation to the publication of information, including reference offers, and cost accounting as to specific activities concerning access.

The Competition Authority has been notified for opinion, and the corresponding specific procedure for the consultation of the European Commission and of the national regulatory authorities (NRA) of the remaining Member States has been started, pursuant to Regicom (Law no. 5/2004, of 10 February).

The deadline for the reception of observations from interested parties is May the 3rd 2005, and such observations should be submitted preferably by email, to the email address mercados_ca@anacom.pt.
