Public consultation on the selection and pre-selection draft Regulation


The selection and pre-selection Draft Regulation and a note explaining it were approved by deliberation of July 21st 2005.

The Selection and Pre-selection Draft Regulation is based on the rules set by the Pre-selection Specification, also applied to Selection where applicable. These rules were modified or adapted taking into account the result of the public consultation on operator selection and pre-selection, the experience gained with the implementation of these resources and the deliberations which ANACOM has been producing on this matter.

The Regulation establishes the principles and rules applicable to selection and pre-selection in public telephone networks, being mandatory for all companies that are part in a selection or pre-selection process, either as direct or indirect access providers. This aims at harmonizing procedures as much as possible, for the final benefit of subscribers.

This draft Regulation, prepared under n.º 4 of article 84 and n.º 1 of article 125 of the Electronic Communications Law (Law n.º 5/2004, of 10 February) as well as paragraph a) of article 9 of ANACOM’s Statutes (Decree-Law n.º 309/2001, of 7 December), is subject to the procedure described in article 11 of these Statutes and also to the general consultation procedure described in article 8 of the mentioned Law.

Under the scope of the consultation procedures now put into motion, interested parties have a 30 working days period to give their contributions. The deadline for the reception of comments is thus September 7th 2005. Comments should be sent, preferably by e-mail, to the address regulamento.sps@anacom.pt.

Under the terms of the same deliberation, the report on the public consultation on operator selection and pre-selection, launched by deliberation of January 22nd 2004, was approved. It contains the analysis of the comments received from the following entities: PT Comunicações, Novis Telecom, Vodafone Portugal, OniTelecom, Telemilénio, Jazztel Telecomunicações, TMN-Telecomunicações Móveis Nacionais.
