Conditions of use

The use of rights of use for numbers or for sub-allocated numbers is subject to compliance with conditions of use.

In any case, it is stressed that:

The provision of electronic communications networks and services must always be carried out in compliance with the general authorisation scheme, under which all companies, whether they use numbers for which they hold the rights of use or sub-allocated numbers, must fulfil all conditions applicable to that provision, including, inter alia, in matters of lawful interception, access to emergency services and information on caller location.
Providers of audiotext services and of message-based value-added services are required to fulfil all obligations associated with the provision of the respective service, in accordance with the scheme for access to and exercisehttps://www.anacom.pt/render.jsp?categoryId=333278 of that activity, including, among others, the conditions and limits associated with the respective access code.

Conditions for using numbers

Depending on the network or service, rights of use for numbers may be subject, inter alia, to the following conditions of use:

Designation of the service for which the number will be used.
Any requirements for the provision of that service, including pricing principles and price caps.
Effective and efficient use of numbers.
Number portability requirements.
Obligations with regard to directory services.
Payment of fees due for the allocation and reservation of rights of use for numbers and for the use of numbers.

Conditions of use attached to rights of use for numbers are specified in the decision on allocation or transfer.

Conditions for using numbers in the context of sub-allocation

In the event of sub-allocation of numbers and in accordance with the Sub-Allocation Regulationhttps://www.anacom.pt/render.jsp?contentId=1714069:

The company holding rights of use is responsible for paying the fee due for the use of numbers, under the Administrative Rule for Feeshttps://www.anacom.pt/render.jsp?contentId=975627.
The company receiving sub-allocated numbers is responsible for:

- compliance with the designation of service for which numbers must be used and with any requirements attached to the provision of that service;

- effective and efficient use of numbers, avoiding their underuse;

- compliance with obligations relating to directory services.

The company holding rights of use and the company receiving sub-allocated numbers are responsible for compliance with requirements relating to the porting of numbers, and in particular the company holding rights of use for numbers is responsible, among other obligations, for:

- managing files and electronic requests for number portability when switching a subscriber from a company to the receiving company and when switching a subscriber from the receiving company to another company; and

- the portability solution, the routing of communications traffic to ported numbers of subscribers of the receiving company and the necessary developments at the level of the network and systems to support portability.
