Conditions of allocation

What does it involve?

The company becomes the holder of rights of use for numbers and is responsible for compliance with the respective conditions of usehttps://www.anacom.pt/render.jsp?categoryId=423505.

Subject to which preconditions?

Prior notificationhttps://www.anacom.pt/render.jsp?categoryId=373715 to ANACOM, by the company, of the commencement of the provision of the electronic communications network or service, in accordance with the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=975162 and the Registration Regulationhttps://www.anacom.pt/render.jsp?contentId=1428570.

How does the allocation take place?

The company must submit an application with its identification and a clear indication of the use for which the requested numbering resources are intended, along with, where applicable, the following particulars:

• Indication of the type or range of numbering resource, including whether a particular resource is preferred.
• Indication of the previously reported electronic communications network or service offer, to be supported by numbering resources.
• Information on the network, including, where applicable:

- the description of the technology to be used;

- a descriptive diagram of its architecture (including, where appropriate, details of its own and other elements);

- the identification of third parties involved in the offer (including companies providing electronic communications networks and services) and their role; and

- how it interconnects with other networks.

• Information on the service, including, where applicable:

- a description of the main features;

- a diagram for easy description of the service (including, where appropriate, details of its own and other elements);

- the identification of third parties involved in the offer (including companies providing electronic communications networks and services) and their role; and

- a identificação de terceiros envolvidos na oferta (incluindo empresas que oferecem redes e serviços de comunicações eletrónicas) e do respetivo papel; e

- how it interconnects with other networks. 

• Indication of the geographical scope of the use of numbering resources.
• Information on the use of numbering resources of the same type or range for which rights of use have previously been allocated.
• Any other information deemed by ANACOM to be necessary, in view of the numbering resources requested, including:

- in the case of level 2 numbers of the E.164 plan, the technical solution which guarantees use of those numbers at a single fixed location, at the network termination point - the customer’s address, situated in the geographical area indicated by the geographically significant digits which make up those numbers, whereby it should be noted that merely establishing the customer’s address by contractual means does not provide a sufficient guarantee to this end;

- in the case of level 9 numbers of the E.164 plan, the ownership of rights of use for frequencies or the conclusion of an agreement for radio access;

- in the case of International Signalling Point Codes (ISPC) of the Q.708 plan, the unique identification of the signalling point (alphanumeric designation), including the location (city), the type of use on the network, the physical address of the signalling point and the month and year of entry into service;

- in the case of National Signalling Point Codes (NSPC) of the Q.704/Q.705 plan, the physical or logical existence on the national territory of a network based on ITU-T Signalling System No 7 or the proven use of an SS7 network provided by a third party and the month and year of entry into service.

The application must be signed:

• In the case of a natural person, by the person him/herself, duly identified, or by his/her representative, if any, duly identified, together with proof of his/her capacity and powers.
• In the case of a legal person, by the legal person itself, duly identified and under the legally established terms, or on behalf of the legal person, by duly identified persons, in the capacity and with the powers for the act, together with proof of that capacity and those powers.

The application should preferably be sent to the email address info@anacom.ptmailto:info@anacom.pt.

Once received, ANACOM checks whether the application has been duly submitted and, if not, the Authority requests, in writing, the correction of any shortcomings which cannot be unofficially remedied, as well as the provision of any information deemed necessary for its consideration.

In general, ANACOM’s decision regarding the allocation of rights of use for numbers is issued, notified and made public within no later than 15 working days.

What does it involve?

The transferee company becomes the holder of rights of use for numbers and is responsible for compliance with the respective conditions of usehttps://www.anacom.pt/render.jsp?categoryId=423505.

Subject to which preconditions?

Prior notificationhttps://www.anacom.pt/render.jsp?categoryId=373715 to ANACOM, by the transferee company, of the commencement of the provision of the electronic communications network or service, in accordance with the Electronic Communications Law and the Registration Regulationhttps://www.anacom.pt/render.jsp?contentId=1428570.

How does the transfer take place?

The transferring and transferee companies must submit an application with their identification and a clear indication of the numbering resources to be transferred, along with, where applicable and duly adapted, the elements required for the application for the primary allocation of rights of use for numbers.

The application must be signed by the transferring and transferee companies, namely:

• In the case of a natural person, by the person him/herself, duly identified, or by his/her representative, if any, duly identified, together with proof of his/her capacity and powers.
• In the case of a legal person, by the legal person itself, duly identified and under the legally established terms, or on behalf of the legal person, by duly identified persons, in the capacity and with the powers for the act, together with proof of that capacity and those powers.

ANACOM’s decision regarding the transfer of rights of use for numbers is issued, notified and made public within no later than 60 working days.

Under the Sub-Allocation Regulationhttps://www.anacom.pt/render.jsp?contentId=1714069, the sub-allocation of numbers is only allowed for the following services:

• Telephone service at a fixed location (2).
• Mobile telephone service (91, 92, 93 and 96).
• Nomadic telephone service (30).
• Universal access service (707 and 708).
• Flat rate call service (760, 761 and 762).
• Freephone Services (800).
• Shared-cost call service (808 and 809).

What does it involve?

The company that sub-allocates numbers remains the holder of rights of use, and both the company holding rights of use for numbers and the company receiving sub-allocated numbers are responsible for compliance with the conditions of usehttps://www.anacom.pt/render.jsp?categoryId=423505 of numbers, in accordance with the provisions of the Sub-Allocation Regulationhttps://www.anacom.pt/render.jsp?contentId=1714069.

Subject to which preconditions?

• Prior notificationhttps://www.anacom.pt/render.jsp?categoryId=373715 to ANACOM, by the company receiving sub-allocated numbers, of the commencement of the provision of the electronic communications service retail offer.
• Conclusion of a contract for wholesale support of the retail offer and for sub-allocation of numbers between the company holding rights of use for numbers² and the company receiving sub-allocated numbers.

How does the sub-allocation take place?

The company holding rights of use for numbers must inform ANACOM, within no more than 10 working days, of the conclusion of each contract for wholesale provision of the electronic communications service and for sub-allocation of numbers.

The company holding the rights of use for numbers sub-allocates numbers to the receiving company in accordance with the contract and with the provisions of the Sub-Allocation Regulationhttps://www.anacom.pt/render.jsp?contentId=1714069. 

The receiving company may only carry out the secondary allocation of sub-allocated numbers to end-users of its own retail offers, and is not allowed to allocate them to other companies or to end-users of other companies’ retail offers.
