NOTAS: | A study prepared for the European Commission DG Communications Networks, Content & Technology by WIK and ICF "This study provides an overview and analysis of the implementation of the Open Internet provisions of Regulation (EU) 2015/212 (OIR) with the aim of assisting the European Commission in preparing the report for the European Council and the European Parliament which is required by Article 9 of the Regulation. The analysis draws on feedback and evidence gathered through an online survey, stakeholder workshop, interviews, and a review of reports prepared by BEREC and National Regulatory Authorities (NRAs). We conclude that we have not identified any aspect of the OIR that requires immediate revision. We have also not identified any aspect of the associated BEREC Guidelines that requires immediate revision. However, there are certain points where the Guidelines could be improved, which could lead to their review. Specifically, NRAs could be encouraged to provide greater transparency on the interpretation of the NTP, and clarity regarding how broadband speed concepts should be interpreted and measured. Consistent “outcome” metrics could also usefully be included in NRAs’ annual reports on the implementation of the OIR. We have suggested that the additional clarity that many stakeholders have requested as regards how to handle different 5G network slicing use cases could be addressed by means of workshops and tutorial guidance." |
